Compliance Updates to Include in Your Employee Handbook Update

A lot happened in the legislative world this past year prompting a need for employers to update their handbooks.

Below is a checklist of important updates to include in your 2024 handbook update.

2024 Handbook Updates

✔️Pregnancy Accommodation - New Pregnant Worker’s Fairness Act that applies to employers with 15+ employees (several states have pregnancy accommodation rules as well.)

✔️Lactation Accommodation - New PUMP Act that applies to all employers.

✔️Artificial Intelligence (AI) Policy - AI is everywhere! Keeping data secure and information confidential is a priority, starting with your policy.

✔️Religious Accommodation - A recent Supreme Court ruling has changed the standard for how employers handle religious accommodation.

✔️E-Verify - Many employers are now using E-Verify to verify remote Form I-9s in light of the government ending the ability for employers to verify identification remotely. (Some states also require E-Verify)

✔️National Labor Relations Board Ruling - The ruling applies to all employers and in a nutshell, is very complex. Policies that govern social media, outside employment, over-broad complaint requirements, complainant confidentiality requirements, and over-broad workplace conduct rules should be reviewed under this new ruling. And, it’s always best to have an attorney review your final draft handbook.

✔️Harassment - Updating prohibited conduct to include pregnancy and childbirth-related harassment, repeated/intentional misgendering, denying access to bathrooms, and adding that harassment can occur virtually are among some of the recommended policy updates.

✔️Overtime Rules (Pending) - the Department of Labor has issued a proposed rule that, if implemented would extend overtime protections to 3.6 million additional workers. Now is a good time to conduct a Fair Labor Standards Act (FLSA) Exempt/Non-Exempt audit in preparation for more to come on this rule.
